Professional Liability: What you need to know.

Professionals such as doctors, lawyers, accountants, financial advisors, engineers, and architects are held to high standards of care and competence in the delivery of their services. When a professional fails to meet these standards and a client suffers harm as a result, the client may pursue a malpractice claim. Professional liability law governs such cases, holding professionals accountable for negligence and ensuring adherence to ethical and industry-specific standards.

What Constitutes Malpractice?

Malpractice occurs when a professional fails to perform their duties with the degree of care, skill, and diligence that is reasonably expected in their field. This failure may take the form of errors, omissions, misjudgments, or deviations from accepted practices. Each claim is highly fact-specific and must be evaluated based on the unique circumstances and professional standards applicable to the situation.

Common Types of Professional Liability Claims

Accountant Liability (Accounting Malpractice)

Accountants owe a fiduciary duty to act with integrity, objectivity, and due professional care. Malpractice occurs when an accountant’s error or omission—particularly a deviation from International Financial Reporting Standards (IFRS)—causes financial harm to a client, such as misstatements, tax filing errors, or audit failures.

Financial Advisor and Broker Liability

Financial advisors, brokers, and registered investment advisers (RIAs) may owe clients a fiduciary duty, particularly where discretionary account management or advisory relationships exist. Negligent investment advice, conflicts of interest, or failure to disclose material information can give rise to broker negligence claims under Zambian law.

Engineering and Architectural Malpractice

Engineers and architects must adhere to safety codes, design standards, and regulatory requirements. Malpractice in this context may arise from faulty designs, construction oversight failures, or project mismanagement that results in harm or structural failure.

Legal Malpractice

Lawyers owe a duty to provide competent, ethical, and diligent representation. Legal malpractice arises when a lawyer’s substandard performance—such as missed deadlines, conflicts of interest, or poor legal strategy—causes a client to lose a case or suffer financial loss.

Medical Malpractice

Healthcare providers, including physicians, surgeons, and specialists, are expected to provide care consistent with accepted medical standards. Malpractice claims may result from misdiagnosis, surgical errors, improper treatment, or failure to obtain informed consent, where such acts cause injury or death to a patient.

Essential Elements of a Malpractice Claim

To succeed in a professional malpractice claim, the claimant must generally prove:

  • Duty and Breach (Negligence): The professional owed a duty to the client and breached that duty through negligence or misconduct.
  • Causation: The harm suffered was directly caused by the professional’s breach.
  • Damages (Substantial Harm): The client incurred significant harm or loss as a result, whether financial, physical, or reputational.

Consequences of Professional Malpractice

Malpractice can lead to serious personal, professional, and financial repercussions, including:

  • Monetary Damages: Professionals may be ordered to compensate the injured party for losses suffered.
  • Regulatory Sanctions: Licensing bodies may impose penalties such as fines, reprimands, or suspensions.
  • Loss of Licensure: In egregious cases, the professional may be disqualified from practicing.
  • Reputational Harm: Malpractice claims can severely damage a professional’s credibility and client base.

The Role and Importance of Professional Indemnity Insurance

Given the high stakes involved, professionals are strongly advised to obtain professional indemnity (malpractice) insurance. This insurance helps mitigate financial exposure by covering legal costs, settlements, and damages arising from malpractice claims. However, policy terms and coverage exclusions must be carefully reviewed to ensure adequate protection.
